CONTRACT
* I hereby register for exhibit space at Junk Bonanza and agree to the event conditions and abide by event procedures. * I understand there are NO REFUNDS OR EVENT CREDITS for any reason, including but not limited to health emergencies and other unforeseen events. - EXHIBITOR COVENANTS
Junk Bonanza is owned by Whaley Marketing Communications, Inc. and will hereafter be referred to as Junk Bonanza - The exhibitor agrees to abide by all stipulated event procedures. Junk Bonanza shall have the final decision in adopting any regulations deemed necessary prior to, during and after the event.
- The exhibitor agrees to observe all labor relations agreements in force, including agreements between Junk Bonanza, the official contractors serving the event facility, and companies operating in the building in which the event is taking place.
- The exhibitor agrees to obtain at his or her own expense any licenses or permits that are required, including without limitation those from government bodies, trade or industry associations and any other third parties, for the operation of the exhibitors business during the event, and agrees to pay all taxes that may be levied against the exhibitor as a result of the operation of his or her business in the space allocated.
- The exhibitor agrees to obey all nonsmoking regulations in effect at the event facility and agrees to ensure that all the exhibitor's officers, agents, employees and those for whom the exhibitor is legally responsible obey the regulations as well.
- Any conduct deemed unprofessional by Junk Bonanza may be grounds for immediate removal of product and exhibitor from current and future Junk Bonanza exhibitions. In such instances there will be no refund of booth fees. Incidents will be handled on an individual basis and all decisions made by Junk Bonanza will be deemed final.
- Junk Bonanza reserves the right to terminate this contract at any time, with or without cause.
- Exhibitor agrees to give Junk Bonanza and or their agents the absolute right to use, publish and distribute all photographs and videos in which exhibitor and/or product may be included for editorial, promotional and any lawful purpose whatsoever and without restrictions.
- Exhibitor agrees to allow Junk Bonanza to use images from exhibitor's social media and/or website for promotional purposes.
- BOOTHS & EXHIBITORS
- The exhibitor agrees to occupy the contracted booth space (and only said space) during the full term of the event and to exhibit only the juried products/categories approved by Junk Bonanza.
- Junk Bonanza reserves the right in its sole discretion to remove exhibitors or items that it considers objectionable and relocate exhibitors when, in Junk Bonanza’s opinion, such moves are necessary to maintain the good order of the event.
- Exhibitor agrees that Junk Bonanza is under no obligation to rent space to exhibitor at future events.
- Booth locations will be rented and assigned in accordance with the best interest of the event. Junk Bonanza will not give any exhibitor exclusivity on any product or product category.
- Exhibitor understands booth placements are based on several factors including but not limited to, date of contract received, overall product mix, and number of booths rented. Booth locations will be posted online approximately 10 days before the event. Specific booth requests cannot be accommodated, though we give priority to returning exhibitors for the booth location they had at the previous event.
- The exhibitor shall not assign any rights under this agreement or sublet the space. Junk Bonanza only allows one exhibitor per space.
- INSURANCE (food/beverage exhibitors only)
- Exhibitors selling food/beverage shall obtain and maintain at their own expense, during the period commencing on the first move-in date and terminating on the last move-out date, a policy of liability insurance acceptable to Junk Bonanza. The policy shall provide coverage of at least $1 million for each occurrence. The exhibitor shall provide a copy of such policy to Junk Bonanza 30 days prior to the event. Exhibitors selling food shall also name Junk Bonanza as the additional loss-insured. See the Junk Bonanza vendor information page online for policy details.
- INDEMNITY
- The exhibitor accepts all risks associated with the use of the exhibit space and environs. The exhibitor shall not make any claim or demand or take any legal action whatsoever against Junk Bonanza or the event facility for any loss, damage or injury, howsoever caused, to the exhibitor, his/her officers, employees and agents, or their property.
- The exhibitor agrees to indemnify and hold harmless Junk Bonanza, show sponsors, the facility and their respective officers, agents and employees, against all claims, costs and charges of every kind resulting from occupancy of the exhibit space or its environs, including personal injuries, death, property damages or any other damage sustained by the exhibitor or his/her officers, agents, and employees; those for whom in law they are responsible; Junk Bonanza; or a visitor at the event.
- EXHIBITOR’S PROPERTY
- All of the exhibitor’s property at the event shall be the sole responsibility of the exhibitor. Junk Bonanza assumes no responsibility for loss or damage thereto.
- BUILDING
- The exhibitor is liable for any damage the exhibitor causes to the event facility or to any property of Junk Bonanza, its agents, or any other exhibitor. The exhibitor may not apply paint, lacquer, adhesives, tape or other coatings to the event facility.
- PAYMENT TERMS, CANCELLATION AND TERMINATION
- Final balance is due by February 3, 2024, including accessories ordered.
- CANCELLATION POLICY: Cancellations for the event along with no shows result in 100% forfeiture of booth fees.
- In the event the exhibitor fails to make payment as aforesaid or fails to comply in any respect with the terms of this contract, Junk Bonanza reserves the right to cancel this contract without notice and all rights of the exhibitor hereunder shall cease and terminate. Any payment made by the exhibitor on account hereof will be retained Junk Bonanza as liquidated damages for breach of contract, and Junk Bonanza may thereupon rent said space. Failure to appear at the event does not release exhibitor from responsibility for payment of the full cost of the space(s) rented. In the event that the exhibitor’s check is returned by a bank due to insufficient funds, a $50 administrative fee will be charged to the exhibitor and a replacement payment must be received within 3 business days of receipt of notification.
- A $50 late fee per booth or per table space will be charged to any exhibitor whose final payment is not made upon contract submission.
- Exhibitor will incur a $50 fee for each clerical change or addition, to be paid to Junk Bonanza.
- Exhibitors who purchase early setup, but do not arrive for setup by 6PM on Tuesday, forfeit the right to setup early that day.
- Exhibitors who do not notify us of late arrival by 3PM on Wednesday will forfeit their booths and 100% of booth fees.
- REMOVAL OF PRODUCT
- The exhibitor agrees that no display will be dismantled, or goods packed or removed during the entire run of the event and will remain intact until the event closing.
- CANCELLATION OF EVENT
- In the event that the facility in which the event is to be held or is held is destroyed or becomes unavailable for occupancy for reasons beyond the control of Junk Bonanza, or if for any reason Junk Bonanza is unable to permit the exhibitor to occupy the facility, or if the show is cancelled, Junk Bonanza will not be responsible for refunding received monies or for any loss of business, loss of profits, damage or expense of whatever nature that the exhibitor may suffer. The reasons listed for event cancellation include, but are not limited to casualty, explosion, fire, lightning, flood, extreme weather, epidemic/pandemic, earthquake or other acts of God, acts of public enemies, riots or civil disturbances, strike, lockout or boycott.
Information - SCHEDULE
- Exhibitors must arrive and be in their allotted booth spaces 30 minutes prior to event opening each day.
- Exhibitors must adhere to event schedule as posted.
- PRODUCT
- All product except those in “Makers’ booth spaces” MUST be 40 years or older or made from materials that are 40 years or older. Artisan-made products must be designed and made by the participating vendor and must be approved by Bonanza. Absolutely no new products or reproductions are allowed, and Junk Bonanza reserves the right to refuse and order removed any new product or reproductions.
- Product categories must be pre-approved by Junk Bonanza.
- Offensive and/or dangerous merchandise is not allowed. Junk Bonanza reserves the right to refuse, and order removed merchandise found unfit by Junk Bonanza.
- DISPLAY & PRICING
- Exhibitor must keep booth space neat in appearance, restocked and staged at all times during the event.
- Exhibitor must keep all property, including but not limited to product, sold product, checkout and display materials, inside designated booth space.
- Exhibitor must keep all back-stock, moving equipment, trash and packing materials stored out of sight. Should items be stored under a table, the table must be skirted to the floor on all 4 sides.
- All merchandise must be clearly marked with a price.
- No artificial flowers, plants or garlands are allowed for display or sale. Only fresh or dried foliage is acceptable for display.
- No plastic/vinyl signage or banners are allowed.
- No clearance, reduced-price, or “sale” signs are allowed at any time.
- SAFETY
- Exhibitor must comply with all fire marshal regulations.
- Booths must have a minimum of a 3’ wide entrance to booth space and a 6’ 8” high clearance to entrance.
- An operational household fire extinguisher must be always accessible.
- Fully enclosed roofs are not allowed.
- All fabric partitions must be flame proof.
- Straw, hay bales, dried corn stalks, flammable partitions, lit candles and the like are prohibited.
- No generators/portable power sources are allowed.
- LOAD-IN AND LOAD-OUT
- During the event, vehicles must be unloaded and immediately removed from the loading area. No vehicle will be permitted in the loading area 30 minutes prior to event opening. All vehicles in loading area must display a parking pass.
- The exhibitor agrees to remove display, trash, equipment and FLOOR MARKING TAPE from the show site by the final move-out time limit. In the event of failure to do so, the exhibitor agrees to pay such additional costs as may be incurred.
- Exhibitor must be completely vacated by 9PM on the last day of the event.
- EXHIBITOR CONDUCT
- Exhibitors must always display POLITE & RESPECTFUL behavior with ALL those associated with the event. Exhibitors displaying behavior deemed disrespectful by Junk Bonanza will be asked to leave the premises and no refunds will be given.
- Exhibitor may not bring animals to the event except for documented service animals.
- Exhibitor is required to always wear lanyard.
